I'm a little rocked by his response as I thought my initial post was written in a calm and constructive manner. IE: I put my initial anger aside, cooled down and then spent the time to write a well thought out response instead of merely flaming away.

All good in any case. I'm still hoping he'll re-consider not using the 'JDMyard inspired' logo in his future work.

Geez, that's a bit rich...it's one thing for an amateur photographer to rip off a professional logo for his own happy snaps, but it's a different kettle of fish when a rival professional wedding photographer passes off your work as his own in an ad....I hope you managed to put a stop to that?

Fucking assholes, the lot of them. I know how you feel - I took a picture of my mate's blue S15 with 350Z Track wheels a while ago, and a few months later someone posted it up saying they took it. I'm not even a professional designer and I got the red mist on.

I would have been OK if they'd credited me for it (since they weren't charging for it either) but no, they said it was their own.

justin i sympathize with you mate... ive got a diploma in 3D graphics and animation, we had it drummed into us the moral and legal ramifications...

i mean seriously, he went to all that trouble to change the jdm yard logo to his own version! really how hard is it just to put your own feckin watermark on a photo!! doesnt have to be anything fancy your name will do it for chrixt sake, so then people will know who i came from!!

man, i'm seriously shocked by that guy's response. It doesn't really matter what Justin's reply is implying, but it is his fault to copy other's design in the first place. Its lucky of him to only copied the jdmyard logo. Just imagine he copied a logo like Mcdonald or Microsoft and then we will see him really get kicked in his ass for it.

On the whole legal action issue... is there grounds for significant action to warrant spending the money on legal action against him???

To me it seems like he's just a recrational user dressing his photo's up and not actually using that logo or anything that could be classed as plagarism of your work for commercial purposes?? I'm not suggesting that you should or shouldn't take legal action. I think the best thing to do would be to contact the administrators of Ozhonda and ask them to remove his images.

Hey there was never ever a point where I even though of suing. I'd always try to resolve something before going to extremes like that.

What people forget is that putting pictures online is a form of "publishing". So saying it's for personal use is one thing but publishing them on a public forum, or anywhere else on the internet is a different story altogether.

I would have loved to stay out of it but I just said something because I had to. Simple as that.

In the end of the day I'm glad he's made all the crazy posts he's made as it shows him for who he really is and perhaps it'll make it easier for everyone who reads the thread to decide for themselves what's right or wrong.

I remember Djaying an 18th Birthday at Warwick Farm in 1997, I was in the garage when a dude was staring at a dudes chick, the chix dude got pissed off, left, cameback to the party in 10minutes, brought 6 cars full of Gangsters with him, my mates mum open the front door, they slashed her wrists because she wouldnt let them in, broke in the house, trashed everything, exited the back door where the party was happening, dudes running with an axe, bat, crowbar, clublock, shopping trolley poles, everyone running past me while the music still pumping, went to the side on the street, one last guy running past with a shotgun, i then decide to cut the music and duck under the table, heard gunfire, screaming, cars rev and screaching, the gangsters all left, cops and ambulances came, a dude was shot in the torso, a few bashed and cuts and my mates mum rushed to the hospital.

My mum heard about the party I djayed and wouldnt let me dj again :lol:
Well, the gigs I did from then on were not around that area anymore :lol:

hmmm Hondas definitely are a big segment of the JDM style of tuning in Austalia, but I reckon the old school nissans and hachis latched on to it before the honda boys.....

Having sampled a wide variety of Hondas in the past year from an S2000, done up EM1 to a race car EK and modified and stock DC2 and DC5 Rs im an avid honda fan and would one day like to own one !!!

Nah man Hachi's weren't happening until Initial-D. It's not like you saw nice JDM Styled Hachi's everywhere on the streets 10 years ago but you definitely saw Honda's with Mugen stickers on them in the late 80's early 90's. That was AGES ago. I remember seeing heaps of Indonesian guys around Kingsford with Hondas slammed to the ground when I was still a kid. Would have been the late 80's.

I didn't see the pics, but mate I feel for ya. One of my design friends asked me to look over a contract for her with Havianas and you just have to make sure you have all avenues covered within reason. Babalouie is right - there is little grounds for litigation unless there was some material gain or loss on either parties.

I've been looking into legislation for design work, and here's some info that may help.

Copyright is free and applies automatically: there is no registration system for copyright and no fees to pay. As soon as the work is created and expressed in a material form (for example, by making the garment) copyright automatically protects the work.

Copyright notice

Although it is not legally necessary, it is a good idea to place the copyright notice on your work. The copyright notice consists of the copyright symbol ©, followed by the name of the copyright owner and the date the work was created. For example, "© Kaf Tan Ltd 2005".

This notice alerts people to the fact that the work is protected by copyright and you are the person claiming ownership of copyright. You can print or write the copyright notice on the work itself or on a label attached to the work"

I guess it may be more difficult for work produced and distributed via the internet, but my recommendation is to keep good records of everything - drafts, ideas journals, storyboards whatever it is - Just incase one day the damage is material and worth suing for. From what I gather about design copyright, the onus of proof in court is on you to prove it is your original work.

Take it as a compliment that someone has regarded your work so highly, and I'm sure that karma will catch up with him one day if he keeps doing it - hopefully the next time he decides to plagiarise someone's work it will be someone like Microsoft or something who will take it further - coz legal fees will only be spare change to them.

I don't think we should make personal remarks here either - its totally unnecessary to bag out something because each person's taste is to their own. If you don't have anything nice to say, its probably better to keep it to yourself. We're all here to hopefully learn something from each other anyway :)

Here is a good info sheet regarding copyright by the Australian Copyright Council. Don't forget to tag on those (C) symbols when producing original work since there are too many leechers on the net.

What used to be known as "poor man's copyright" in the olden days was to print out what you wrote/designed, then stuff it in a reg'd envelope and mail it to yourself.

Reg'd mail has a time-stamp on it, so as long as you don't go and forget what it is and open it :) then you should have decent proof of the time you came up with it.

Dunno if it still works today but writers used to do it all the time decades ago.

I suppose it depends who's being hurt. In this particular case I couldn't take it as a compliment because they were not ripping off my own personal work, it was a commercial job for a commercial company. That makes it a little different.
